Practice Emphasis:
David W. Berry is an experienced lawyer with extensive successful trial experience. Many of his cases are complex and
involve multiple parties. He represents individuals and companies in business, real property, construction defect,
banking and other disputes. In 2008, he was recognized by the North Bay Business Journal as one of the forty exceptional
business leaders under forty years of age in Sonoma, Marin, and Napa Counties.
Mr. Berry has tried jury and bench trials and arbitrated matters throughout northern California. He teaches and has published
articles on various real property issues, including easements. He won a challenging trial where he proved that his client owned
a part of the neighbor’s land by way of adverse possession. He helps clients protect their property rights by establishing,
defending, or extinguishing easements and licenses. He has helped commercial building owners and homeowners collect millions
of dollars to repair defectively constructed buildings. He handles myriad business and banking disputes, from breaches of
simple contracts to enforcement of complicated commercial and banking agreements.
Prior to joining Abbey, Weitzenberg, Warren & Emery in 2002, Mr. Berry was deputy district attorney prosecuting criminal
cases and an attorney at the international firm, Brobeck, Phleger & Harrison. As a D.A., he successfully prosecuted hundreds
of cases. At Brobeck, he helped international corporations resolve multi-state class-action litigation and prominent families
resolve disputes regarding multi-million and hundred-million dollar estates. He favorably defended a major corporation sued
for the aborted purchase of seven hundred acres of prime farming land.
Mr. Berry has a long and consistent history of community service. He was a member of the Board of Directors of Legal Aid of
Sonoma County from 2001 through 2005, and its President in 2005. He is on the Bench/Bar Committee of the Sonoma County Bar
Association, and a member of both the American Inns of Court and the Santa Rosa Active 20-30 Club, which helps underprivileged
children in our community. Recently, he became a member of the twenty-fifth class of Leadership Santa Rosa, which is a year-long
educational program for selected community leaders. It is intended to develop and equip class members via exposure to pertinent
issues, broad thinkers and the richness of Santa Rosa and Sonoma County.
